PLEASE NOTE – The Terms and Conditions listed below (points 1 – 13) pertain to the HOTEL ONLY bookings on this website. 1. Use of the ‘Booking Service’ and website by you (“the Customer”) is subject to the following terms and conditions:

  • Bookings made to ‘the ‘Booking Service’ by the Customer are made on behalf of the accommodation provider. The Customer agrees that the Accommodation provider has sole responsibility for delivery of the services being booked by the Customer and that ‘the ‘Booking Service’ is not liable for default by the accommodation provider.

2. The Customer agrees to pay to ‘the ‘Booking Service’ by debit to Customer’s credit card account the specified booking fee and cost of the accommodation. All fees are Tax inclusive where applicable. The ‘Booking Service’ will issue the Customer with a valid confirmation in respect of this booking service.

3. The ‘Booking Service’ receives a payment from the accommodation provider for providing this booking service.

4. The customer acknowledges that a third party (“Card Authoriser”) will process the credit card transactions required in respect of a booking. The Customer agrees that the ‘Booking Service’ is not liable for default by the Card Authoriser.

5. Cancellation penalties depend upon individual accommodation provider policies and can be supplied at time of booking. An administration fee of $20 AUD applies to all booking cancellations and amendments. The balance of funds remaining (if applicable) will be refunded to the specific credit card used to make payment at the earliest opportunity.

  • You may be required to present photo ID on arrival at the accommodation provider premises. A credit card imprint or cash deposit may be required to cover incidental charges.

6. Information on the ‘the ‘Booking Service’ website is based on information supplied by each accommodation provider. Whilst the ‘Booking Service’ endeavours to ensure all information presented is accurate, it makes no guarantee that the information is free from errors or faults, and accepts no liability for any errors or omissions as all information in relation to accommodation and premises is provided by the accommodation provider.

7. The ‘Booking Service’ makes no warranty or representation about the suitability of any product or service being advertised on its website.

8. The ‘Booking Service’ does not pay commissions to travel agents using this booking service.

9. The ‘Booking Service’ reserves the right to change information published on its website at any time.

10. The ‘Booking Service’ needs to collect personal information about you to process your booking for accommodation. If the ‘Booking Service’ cannot collect this information, it will be unable to make a booking in your name. The ‘Booking Service’ respects your privacy and will only use or disclose your information in accordance with the Privacy Act 1988. Please read our privacy policy.

11. If you wish to make a booking, we will provide your information to the accommodation provider so that your booking may be processed.

12. This agreement is governed by the laws of where the ‘Booking Service’ is located (unless otherwise specified) and the parties agree to the appropriate jurisdiction for any legal proceedings arising out of this agreement.

A condition of booking with www.bookchinaonline.com.au is the acceptance of the terms and conditions as set out below and it is acknowledgement that you have read, understood and have agreed to be bound by them. We strongly suggest that you read all of the terms and conditions applicable to your chosen itinerary prior to making your payment and should you be unsure, then contact www.BookChinaonline.com.au.

www.BookChinaonline.com.au may from time to time amend these terms & conditions and any amendment will take place from the time that the amended conditions are loaded onto the www.BookChinaonline.com.au website.

This protection scheme provides all of our customers with peace of mind, knowing that you are dealing with a reputable and financially secure organisation.

All flight availability, pricing and fare rules are provided to us by the relevant airlines. www.BookChinaonline.com.au has no control over seat availability or fare rules and has no authority to waive any airline fare conditions or rules. In the event of an error by these suppliers we reserve the right to amend your booking as required and any additional fare charges may need to be paid by you the client so as to comply with the relevant airline regulations. If you do not understand any fare rule or need assistance, you must contact Bookchinaonline before purchasing your tickets.

All personal information requested in the making of any reservations is used solely for the purpose of professionally handling the reservation process. We may be required to provide some or all of the information given to a third party for the purpose of completing your reservation. You accept that any third party may have a different privacy policy in place.

You authorise us to disclose your credit card details to, and obtain information from, any financial institution or credit card provider to verify the credit card and the identification details that you provide to us. You also authorise your credit card issuer or financial institution to verify that the credit card and identification details you have provided to us are accurate. You authorise us to take whatever steps are reasonable to confirm that there is sufficient credit in your credit card account to cover any purchase that you are making. www.BookChinaonline.com.au will not issue any Airline tickets until such time as the authorisation has been received from the relevant card company. www.BookChinaonline.com.au reserves the right to refuse service where we are unable to verify the ownership or identity of a credit card provided or obtain authorisation. We reserve the right to request additional information from you to verify the ownership and integrity of the credit card information provided. By completing your reservation you are authorising us to charge all costs incurred to the credit card as provided by you. Should we be unable to obtain authorisation from the credit card provider any reservations held may be cancelled at our discretion. www.BookChinaonline.com.au reserves the right to charge any amendment or cancellation fee(s) as levied by the relevant airline(s) depending on the individual circumstances and airline conditions.

www.BookChinaonline.com.au reserves the right to decline or accept bookings made from outside Australia. Any automatic booking confirmations received for any such bookings are conditional on us accepting the reservation.

Please ensure that you have a valid Passport and any Visa(s) as applicable for the countries you are travelling to. Failure to have the correct documentation at the time of travel may require the applicable airline to refuse you service and charge you any applicable amendment or cancellation penalties applicable until such time as you have the correct documentation for the itinerary to be travelled.

Should your travel plans change and you request a refund of any airfare booked via the www.BookChinaonline.com.au website, please contact us immediately. Many airfares are non-refundable or cancellation fees may apply to your particular airfare. Processing times for refunds are beyond the control of www.BookChinaonline.com.au. Refunds can regularly take up to 12 weeks or more.

Terms and Conditions - General Tour Products

TOUR PRICES

All prices shown are per person in Australian Dollars and are correct as of 21 December 2012. Prices would be subject to change without notice in the unlikely event of major currency fluctuations or changes to service providers’ tariffs. China Holidays reserves the right to amend tour costs at any time and acceptance of this facility is considered a condition of making a reservation. Should an amendment be necessary it will be advised to your Travel Agent. We strongly recommend that you check regularly with your Travel Agent for any amendments. All prices displayed cover only the inclusions as detailed in the applicable itinerary. China Holidays will not provide a breakdown of prices on any of the requested quotations, regardless of the booking type. Any quotation request may be declined if incomplete or vague details are provided.

TOUR PRICE EXCLUSIONS

International airfares, Airline fuel surcharges and airport taxes (unless specified); passports, visas and applicable vaccinations; tips to your tour director, driver or local guides; gratuities on cruise ships & ferries; laundry; beverages and food (unless specified in your itinerary); optional excursions, porterage at airports or any other items of a personal nature.

PASSPORTS & VISAS

All clients must be in possession of a valid passport with a minimum of at least six (6) months validity and all necessary visas applicable to their itinerary at the time of commencement of travel. All such documentation is the sole responsibility of the client. You travel agent may assist, on your request, to organise the necessary travel documentation. China Holidays accepts no responsibility or liability whatsoever for the failure of any client to obtain the correct documentation.

TRAVEL INSURANCE

Comprehensive travel insurance is available from China Holidays or your Travel agent for all Australian based clients at the time of reservation to cover against various contingencies such as loss of deposit and/or fare due to cancellation; loss of or damage to baggage; loss of money or travel documents; medical expenses, curtailment charges; personal accident and/or personal liability. China Holidays chosen insurer has actual medical representation within China.

HOTEL ACCOMMODATION

Accommodation is based on twin or double-bedded rooms. Triple share accommodation will consist of two single beds plus a rollaway bed. The hotels listed in this brochure will be used on all departures. If a change should become necessary for any reason, the hotel substituted will be of an equivalent standard to those shown. Any hotel description is based upon advice received from the applicable hotel and whilst China Holidays will make every effort to ensure that all details are correct at the time of printing, China Holidays can take no responsibility for information used in good faith. Normal check-in time for hotels in China is 3pm and any arrival before this time may lead to a room not being readily available.

AIRFARES

There are a number of Domestic and International airfares that may be used with your holiday package. These airfares will have special conditions and will be subject to availability.

If your travel plans change and we have to change your previously issued ticket, China Holidays Australia charges: $25.00 reissue fee per ticket for domestic flights $50.00 rebooking/reissue fee per ticket for international flights $100.00 cancellation processing fee per ticket for both domestic or international flights. These fees are charged in addition to the changes fees/penalties and any airfare difference that may be imposed by the airlines directly; however, some tickets may be non-refundable and unavailable for rebooking. Please email us your name, booking number and what you want to change. We will process it and let you know the exactly cost.

DEPOSITS & PAYMENTS

A non-refundable deposit of $500.00 per person must be received by China Holidays within 7 days of confirmation and balance payment is due no later than 42 days before departure from Australia. For bookings made within 42days of departure from Australia, deposit is due within 24hours and balance payment within 7days. Any booking not paid for at the designated time may incur a late payment fee of $2.00 per day. Payments by credit card will incur a surcharge of 2% for Visa & Mastercard and 4% for American Express & Diners cards.

AMENDMENTS

Any amendment to your holiday may incur fees. An amendment is considered to be a change to your booking where the booking value does not increase. Your first amendment is complimentary. Any subsequent amendment will incur a fee of $35.00 per change per booking. Amendments made after documentation has been issued will incur a reissue fee of $100.00 plus any airline or supplier reissue fees. A transfer to an alternative tour is considered a cancellation and subsequent fees will be applied.

LATE BOOKINGS

Any reservation made within 8 to 14days prior to departure will incur a non-refundable Late Booking fee of $25.00 per booking whether the reservation can be confirmed or not. Any reservation made within 7days of departure will incur a fee of $50.00 per booking. Any quotation made outside of 14days that is subsequently requested to be booked within 14days will incur the appropriate Late Booking fees.

Full payment for your holiday together with the applicable Late Booking fee must be received by China Holidays within 48hours of booking. No reservations will be processed until the applicable payment has been received by China Holidays. Failure to comply with these terms will result in the automatic cancellation of the reservations request.

CANCELLATIONS

Should you wish to cancel any reservation made, there will be no refund of your deposit. If you cancel within 60days of commencement of travel 25%of the Land content will be charged. For cancellations within 30days of commencement of travel 50% of the land content will be charged.

No refund will be available for any cancellation within 7 days of commencement of travel or for any portion of your itinerary that is not utilised for any reason.

CANCELLATIONS BY US

Some Group tours operated by China Holidays may be subject to a minimum of 10 people travelling. On any occasion where less than the minimum number of participants materialises, we reserve the right to re-cost the tour with alternative arrangements or to cancel the tour. If you do not accept our alternative arrangements, we will refund all payments made by you to China Holidays but we will not be liable for any claims made, damage, additional expenses or consequential loss suffered by you.

TOUR OPERATION

Although China Holidays will endeavour to ensure that holidays are available as advertised, an express condition of making any reservation is the acceptance by the client that tour itineraries and schedules, advertised accommodation, sightseeing programmes and modes of transport as outlined in this brochure and/or supplied in pre-departure information are subject to change without prior notice. Air travel, coach journeys and other forms of transport as well as accommodation are provided by independent operators and all reservations through China Holidays are subject to terms, conditions and limitations of carriers, hoteliers and other service providers.

HEALTH REQUIREMENTS

In general a good level of fitness is required whilst touring in China as there are sometimes long days with considerable amounts of walking; or walking over uneven terrain, long coach or overnight train journeys and on certain tours changes of altitude. We strongly recommend that all clients familiarise themselves with any health requirements applicable to the areas they intend to visit. The client is solely responsible for compliance with any vaccination and/or other health requirements of governments in countries visited or transited. The Department of Health or your preferred medical practitioner will be able to advise with the current requirements and recommendation.

LUGGAGE

We recommend that you only pack and bring with you luggage that you can safely handle yourself if required. Whilst porters are available at larger hotels, coach parking areas at some airports or train stations may be some distance. The airline regulation baggage allowance for travel in Economy class is 20Kgs and is often strictly adhered to. Please ensure that you make every effort to comply with this restriction. Cabin baggage should not exceed 5Kgs and there are restrictions on the carriage of liquids or any kind inside aircraft. Please refer to the applicable airline or check with your travel agent of China Holidays for details.

RESPONSIBILITY

There is no contract between China Holidays and the client or their agent until such time as the company has received the appropriate deposit and ha confirmed acceptance in writing. An account will be sent with the confirmation and should be settled by the specified dates. Should payment not be received as requested, China Holidays reserves the right to cancel the booking with the consequential loss of deposit and to apply the applicable cancellation charges. China Holidays has the right at any time and for any reason to cancel the contract prior to the date of departure; and if it does so, its liability shall be limited to refunding all monies paid by the client,

Or to amend, alter, vary or withdraw any tour, holiday excursion or facility it has advertised or published or to substitute a hotel of similar class and/or standard if it is deemed advisable or necessary. In either case the company shall not be liable for any damage, additional expense or consequential loss suffered by the client. No person other than an authorised member of the company (in writing) has the authority to vary, add, amplify or waive any description, representation, term or condition set forth in this brochure. In the event of the company exercising its rights to amend or alter any tour or holiday that has been booked, the client shall have the right to continue with the tour or holiday as amended or altered, or to accept an alternative tour or holiday which the company may offer. In either of these cases the company shall not be liable for any damage, additional expense or consequential loss suffered by the client. The company will under no circumstances whatsoever be liable to the client or any person travelling with the client for any damage, personal injury, sickness, accident, loss, delay, increased expense, consequential loss or any misadventure caused; any act, omission, default of any proprietor, carrier or other person or by an employee or agent concerned in the provision of accommodation, refreshment, carriage facility or service for the client or of any person travelling with them howsoever caused. The temporary or permanent loss of or damage to baggage or personal effects howsoever caused. In this condition “howsoever caused” includes negligence on the part of any person. No liability on the part of the company arising in any way out of this contract in respect   of any tour or holiday excursion facility shall exceed the total amount paid or agreed to be paid for the tour or holiday, and shall in no case include any consequential loss or additional expense whatsoever. Any claim or complaint by the client must be notified to the company in writing within 28days of their return from the tour or holiday. No claim, communicated verbally or in writing to the company outside of this period will be entertained and the company shall incur no liability whatsoever in respect thereof. Each of these conditions shall be severable from the other and if any provision should be found to be invalid, illegal or unenforceable, the remaining provisions shall nevertheless have full force and effect.

LAW OF CONTRACT

The booking conditions as set out herein form the basis of the contract between “The Company” and “The Passenger”. This contract is governed in all respects by the laws of the state of New South Wales and any legal action arising from within the conditions of the contract shall only be litigated in the appropriate court having jurisdiction in that state.

PASSENGERS WITH DIASBILITIES OR PASSENGERS REQUIRING ASSISTANCE

International airlines, Cruise vessels and hotels have special facilities for people with disabilities or who require assistance. Please inform your travel agent or China Holidays consultant if you have any special needs.
